1. Introduction to the terms and use agreement and privacy
Please read these terms of use carefully before accessing or using the alcure.me website or the Alcure digital health platform. These terms of use apply to the alcure.me website, the Alcure digital health platform, Alcure LLC, and each of Alcure LLC's contractors and affiliates (collectively "Alcure"). Our address to which any written inquiries may be sent is Alcure LLC, 17875 Von Karman Avenue. Ste. 150, Irvine, CA 92614, and inquiries may also be sent to support@alcure.me.
Access to or use of the alcure.me website or the Alcure digital health platform constitutes a legally binding agreement between you and Alcure. Each time you access the alcure.me website or the Alcure digital health platform you are automatically agreeing to the most recent version of this agreement.
If you do not accept this agreement in its entirety then you may not visit, access or use the alcure.me website or Alcure digital health platform.
Alcure may modify the terms of this agreement at any time and will post modifications on this page of the alcure.me website. Modifications are effective once posted and correspond with the stated date of the modification or "Latest version" of this agreement. It is your responsibility to carefully review this agreement each time you visit the alcure.me website or use the Alcure digital health platform.
2. Eligibility
You affirm that you are at least 21 years old and a resident of one of the states we service as published on the alcure.me website to use the Alcure digital health platform. Because of the nature of the telehealth services we offer, Alcure is not able to provide service to anyone under the age of 21 and upon notification or discovery that any user is under the age of 21, Alcure must immediately discontinue service. Alcure also requires all users of its digital health platform to provide honest and accurate information at all times and failure to do so will result in immediate discontinuation of service.
3. Service offered
Alcure is not an online pharmacy. Alcure is a wellness-based telehealth service focused on assisting individuals reduce alcohol use and at the same time develop healthy lifestyle habits. Alcure does not promote any prescription drugs, but does educate on the use of medication and offers e-prescribing of medication, with the medication cost being borne entirely by the client. Alcure promotes telehealth services generally.
Alcure is also not a laboratory. From time to time its contracted health care providers may require you to obtain laboratory tests to continue with service. Such tests are provided through a contracted laboratory and priced separately. Alcure will advise you in advance of any additional medical services, including lab work and prescriptions for medication designed to mitigate potential side effects of the primary medication it prescribes to treat Alcohol Use Disorder, including pricing.
Alcure is a telehealth platform for physicians, credentialed counselors and coaches (collectively "medical providers") to work with you in a more accessible and efficient way. All medical providers are independent contractors and are not employees of Alcure. The role of the alcure.me website and digital health platform are to facilitate the medical providers' interaction with you. All treatment decisions are handled exclusively by medical providers.
Medical provider services are provided exclusively through telehealth, which refers to online communication between medical providers and patients, including video chat, email, texting, and telephone communication. Telehealth also refers to the electronic prescribing of medication to patients and maintaining patient medical records privately and electronically.
All charges collected from you are allocated exclusively for services provided to you in using the Alcure digital health platform and are not allocated to any other service or product unless specifically designated.
4. Content is for information purposes only
The alcure.me website nor any advertising associated with it or the alcure digital health platform, including written content, imaging, and any video imaging ("content") are for informational purposes only. Content is not a substitute for medical advice, diagnosis, prognosis, or treatment. Any questions you may have regarding any health-related condition should be immediately addressed with a qualified healthcare provider, and you should not disregard medical advice or delay in seeking medical advice based on any content published by Alcure. If you believe you are someone you are with is facing an urgent medical situation or emergency, call 911 immediately. Alcure does not provide urgent medical advice or services through the alcure.me website or its digital health platform.
5. Limitation of services
Alcure telehealth services should not be considered your primary source of medical care and are not intended to be a substitute for care with a primary care physician. As such, you should advise your primary care physician of your care with Alcure and all medication prescribed by Alcure, and also advise your health care provider on the Alcure digital health platform of all medications are taking and all medical conditions you have to optimize care and reduce the risk of contraindicated drug interactions or treatments. In other words, be transparent with all of your health care providers, including those on the Alcure digital health platform regarding all medications, whether prescribed or over-the-counter, legal or illegal and all medical conditions you have for your safety. You may elect to have your Alcure healthcare provider communicate directly with any other health care provider by contacting support@alcure.me.
Though Alcure provides a robust technology supporting its digital health platform, it cannot guarantee against risk in loss of electronic data, delay in electronic transmissions and communications, quality in electronic transmissions and communications, third-party "hacking" or data loss.
Alcure requires all clients to answer a health questionnaire that includes more detailed terms regarding (1) consent to telehealth treatment, (2) privacy, and (3) informed consent for treatment. The form is found by clicking on the "Start" button found on the alcure.me website and all terms set forth in each of these forms are incorporated by reference herein.
6. Pricing, private pay, insurance
Unless pricing is posted on the alcure.me website, interested persons may contact support@alcure.me to receive pricing information or may fill-out our medical questionnaire by clicking one of the Start button on the site, following the prompts, and they will be taken to a price disclosure page. All pricing is subject to change.
Alcure is private pay digital health platform. If a client has medical insurance we'll help you get reimbursed. Upon request, Alcure will provide to you a "superbill" which is a detailed receipt identifying the medical codes used by insurance companies to process payment, which you may submit to your insurance company requesting full or partial reimbursement. Alcure does not guarantee or make any representation as to whether your insurer may or will reimburse any payment made to Alcure for its service.
7. Intellectual property
Alcure is the sole owner of all content and design, whether in text, image, video or sound recorded format associated in any way with the alcure.me website and the Alcure digital health platform, including its online forum, and all are protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws. Your use of the alcure.me website or Alcure digital health platform is strictly for personal, non-commercial use by you and you may not reproduce or distribute in any way whatsoever any of the foregoing except as permitted by this agreement. All names associated with Alcure, including logos, slogans, titles, and other expressions are subject to trademark, trade name, service mark or related mark or goodwill protection. You may not use any such information without the written consent of Alcure.
8. Cancellation and Pausing of Account, Refunds.
You may cancel or service any time and you are only responsible for the month in which you cancel. Alcure may cancel your service and subscription at any time for any reason in its sole discretion.
9. Disclaimers
You agree that use of the alcure.me website or Alcure digital health platform is at your sole risk. Alcure expressly disclaims all express and implied warranties, including any warranty of merchantability or fitness for a particular use, lack of infringement, guarantee of outcome, lack of side-effects of any medication its providers prescribe, discovery by other persons or entities of the services it provides to you including the medication prescribed and directed for use by you, functionality of its digital health platform, data protection or preservation of data, accuracy of data you provide, and integration of that data with the Alcure systems or it health care providers or affiliates.
You, along with your respective heirs, family members, successors, assigns, agents, representatives, shareholders, officers, directors, partners, managers, employees, former employees, sureties, administrators, trustees, members, principals, and beneficiaries hereby fully and forever waive, relinquish, release and discharge Alcure and its respective successors, assigns, agents, representatives, shareholders, officers, directors, partners, managers, employees, former employees, sureties, insurers, administrators, trustees, members, principals, beneficiaries, and all persons, firms, associations, subsidiaries, and/or corporations connected with them, and each of them, from any and all claims, demands, controversies, losses, damages, actions, causes of action, debts, liabilities, costs and expenses (including, without limitation, attorneys’ fees, experts’ fees, consultant’s fees and court costs), and obligations of every kind or nature whatsoever, in law or equity, in contract, tort or otherwise, anticipated or unanticipated, direct or indirect, fixed or contingent, which may presently exist or may hereinafter arise or become known arising out of, caused by, incurred in connection with or in any way pertaining to content on the alcure.me website or the services provided on the Alcure digital health website to the maximum extent permitted by law.
Testimonials appearing on the alcure.me website are obtained from prior or existing clients of Alcure either from their voluntary statements to Alcure or from means by which Alcure seeks feedback information from clients. Testimonials reflect subjective statements of individual clients based on their experience in using the Alcure digital health platform and should not be construed as an objective, typical or representative outcome of what you or another client, or prospective client, will experience in using the Alcure digital health platform, including specifically reductions or outcomes in the volume or frequency of consuming alcohol over time, and duration in obtaining such outcomes.
Alcure does not pay any client for testimonials or otherwise discount charges or compensate clients in any fashion whatsoever for testimonials. All testimonials are displayed exactly as stated by our clients. We only correct for spelling and we may shorten statements into segments or add brackets for clarity. For client privacy reasons, images placed next to testimonials are not of actual Alcure clients but are representative of age, gender, and background.
You agree that all disputes with Alcure or its affiliates are governed by the laws of the state of California and that any and all legal actions against Alcure or its affiliates shall be filed within the state of California, County of Orange, Superior Court of the state of California and not federal court. You agree that to the maximum extent permitted by law this agreement shall be deemed performed in the state of California and that if there is a conflict with a valid law of any jurisdiction, then performance will be modified to the minimum extent necessary to comply so that it conforms to the maximum extent possible with all terms of this agreement.
10. Indemnification
You agree to indemnify, defend and hold harmless Alcure and its respective successors, assigns, agents, representatives, shareholders, officers, directors, partners, managers, employees, former employees, sureties, insurers, administrators, trustees, members, principals, beneficiaries, and all persons, firms, associations, subsidiaries, and/or corporations connected with them, and each of them from and against any claim, actions, demands, liabilities and settlements, including without limitation reasonable legal fees and litigation costs of any kind associated with, arising from or related to in any way whatsoever your violation of this contract and waive any defense based on substantial compliance with the terms of this agreement. The terms of this indemnification expressly extend to all health care providers, including therapists and coaches operating on the Alcure digital health platform, associated in any way whatsoever with the above and in particular with your lack of adherence with the advice or recommendations of such healthcare providers, therapists and coaches, including specifically the content of the accelerator tutorial videos provided to you as part of our service.
11. Privacy
Alcure grants you a limited license to access and make personal use of the alcure.me website. Alcure asks for certain information such as your real name, birth date, address, phone number, and email address when you sign-up or if you communicate with Alcure. Information communicated to Alcure is maintained in accordance with HIPAA (Health Insurance Portability and Accountability Act) which is a federal law requiring health information privacy and security for patients. Such information will be collected and transmitted in compliance with HIPAA, and by using the alcure.me website or Alcure digital health platform you agree to the collection and transmission of all your information to the maximum extent permitted by HIPAA and all other related laws. Alcure also collects payment information from you using Stripe, which provides encryption technology to process payments. Stripe does not provide Alcure credit card numbers but does provide other credit card data.
Alcure will use your information for purposes to include, but not limited to, fulfilling our service obligations to you, improve the quality of service we provide to you and others, to notify you of modifications to our service, to market and promote the alcure.me website and Alcure digital health website, to fulfill any other purpose designated or authorized by you expressly or impliedly.
Alcure reserves rights to publish client treatment outcomes during or following treatment but without any identifying information of the client so that these publications are kept anonymous and comply with patient privacy requirements. Alcure may request client feedback and testimonials which you may either accept or decline to provide.
Alcure does not employ the use of tracking technology on its website or any of its website pages. Tracking technology is commonly used by other websites to collect user data for analytics insights and marketing. Since tracked website information can contain protected health information and would otherwise be collected without your full informed consent and waiver of medical privacy rights in advance, Alcure does not collect it.
